1. Acceptance of Terms

By accessing and using "Omoide-Tap" (hereinafter referred to as "the Service" or "the App"), operated by Nawawa Japan (hereinafter referred to as "we", "us", or "our"), you agree to comply with and be bound by these Terms of Service. If you do not agree to these terms, please do not use the App.

2. Description of Service

The App provides a web-based gallery interface and allows users to capture and save photos/videos directly to their personal Google Drive using Google OAuth authentication. The App does NOT store any photos or videos on our servers; all media is stored exclusively in the user's own Google Drive.

3. User Responsibilities & Google Drive Storage (Important)

The App relies ENTIRELY on your personal Google account and Google Drive storage. By using the App, you acknowledge and agree to the following:

  • Storage Quota: All photos and videos taken through the App are saved to your personal Google Drive, consuming your own storage quota.
  • Insufficient Storage: We are NOT responsible for any failure to save, upload, or display photos/videos if your Google Drive storage is full or insufficient.
  • Account Security: You are responsible for maintaining the confidentiality of your Google account credentials.
  • Public Link Sharing: When you upload media via the App, the file's permission is set to "anyone with the link can view" so that guests holding the NFC card can access the album. You acknowledge and agree to this public-link sharing model.
  • Deletion: When you delete media within the App, the corresponding file is permanently deleted from your Google Drive. This action cannot be undone.

4. Prohibited Conduct

You agree not to use the App for any of the following purposes:

  • Uploading any content that is illegal, infringes on third-party rights, or violates public order and morals.
  • Reverse engineering, decompiling, or attempting to extract the source code of the App.
  • Interfering with the operation of the App or imposing an unreasonable load on our infrastructure or Google's API.
  • Impersonating another person or using another user's NFC card without permission.

5. Disclaimers and Limitation of Liability

The App and its services are provided on an "AS IS" and "AS AVAILABLE" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied. We shall NOT be liable for:

  • Any loss of data, photos, or videos due to network errors, user errors, or Google API outages.
  • Any interruption or cessation of the service caused by changes in Google's API policies or service terms.
  • Any indirect, incidental, or consequential damages arising from the use of the App or physical NFC cards.
  • Any unauthorized access to your album resulting from the loss or theft of your NFC card or leakage of the guest passcode.

6. Intellectual Property

All UI designs, software code, and branding elements of the App are owned by us. The photos and videos you take and upload to your Google Drive remain your exclusive property.

7. Modifications and Termination

We reserve the right to modify these terms or discontinue the App's service at any time without prior notice. You may terminate your use of the App at any time by revoking the App's access in your Google Account settings (https://myaccount.google.com/permissions).

8. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Japan. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Japan.

1. 規約の適用

この利用規約（以下「本規約」）は、Nawawa Japan（以下「当社」といいます）が運営する「Omoide-Tap」（以下「当アプリ」または「本サービス」といいます）の利用条件を定めるものです。ユーザーは、当アプリにログインし利用を開始した時点で、本規約に同意したものとみなされます。

2. サービスの内容

当アプリは、専用のギャラリーインターフェースを提供し、Google OAuth認証を用いて、ユーザー自身のGoogle Driveへ直接写真や動画を保存・閲覧できるWebアプリケーションサービスです。当社のサーバーには写真・動画を一切保存せず、すべてのメディアはユーザー自身のGoogle Drive上にのみ保存されます。

3. ユーザーの責任とGoogle Driveの容量について（重要）

当アプリのデータ保存機能は、ユーザー自身のGoogleアカウントおよびGoogle Driveのストレージに「完全に依存」しています。ユーザーは以下の事項を了承するものとします。

  • ストレージ容量の消費： 当アプリ経由で保存されたすべてのデータは、ユーザーご自身のGoogle Driveに保存され、ストレージ容量を消費します。
  • 容量不足に関する免責： Google Driveの容量が上限に達していることが原因で、写真や動画が保存・表示できなかった場合、当社は一切の責任を負いません。
  • アカウント管理： お客様ご自身のGoogleアカウントのセキュリティ管理は、お客様自身の責任で行うものとします。
  • 公開リンクによる共有： 当アプリでメディアをアップロードする際、NFCカードを所持するゲストがアルバムを閲覧できるようにするため、ファイルの権限を「リンクを知っている全員が閲覧可能」に設定します。ユーザーはこの公開リンク共有モデルを了承するものとします。
  • 削除操作について： 当アプリ内でメディアを削除すると、対応するファイルはお客様のGoogle Driveから完全に削除されます。この操作は取り消すことができません。

4. 禁止事項

ユーザーは、当アプリの利用にあたり、以下の行為をしてはなりません。

  • 法令または公序良俗に違反する行為、もしくは第三者の権利を侵害するコンテンツのアップロード。
  • 当アプリのリバースエンジニアリング、逆コンパイル、ソースコードの抽出を試みる行為。
  • 当アプリの運営を妨害する行為、または当社インフラもしくはGoogle APIに過度な負荷をかける行為。
  • 他人になりすます行為、または他のユーザーのNFCカードを許可なく使用する行為。

5. 免責事項

当アプリは「現状有姿」で提供され、特定の目的への適合性や完全性についていかなる保証も行いません。当社は以下の事象について、一切の損害賠償責任を負わないものとします。

  • 通信エラー、端末の不具合、またはGoogle APIのシステム障害によるデータの消失や保存の失敗。
  • GoogleのAPI仕様変更、規約変更に伴う当アプリのサービス提供の停止または中断。
  • 当アプリ、および物理的なNFCカードの利用に関連して生じた間接的、偶発的、または派生的な損害。
  • NFCカードの紛失・盗難、またはゲストパスコードの漏洩により生じたアルバムへの不正アクセス。

6. 知的財産権

当アプリのUIデザイン、システムコード、ロゴ等の知的財産権は当社に帰属します。ただし、お客様が撮影しGoogle Driveに保存した写真や動画に関する権利は、すべてお客様自身に帰属します。

7. 規約の変更およびサービスの終了

当社は、事前の通知なく本規約を変更、または当アプリのサービスを終了することができるものとします。ユーザーは、自身のGoogleアカウント設定からアクセス権を取り消すことで、いつでも当アプリの利用を終了することができます。

8. 準拠法および管轄

本規約は日本法に準拠し、本規約に関連して生じた一切の紛争については、日本の裁判所を専属的合意管轄とします。
